Federal District Allows
Same-Sex Marriage & Joint Adoption
On 21st December 2009 Mexico's Federal
District, by amendments to its Civil Code, opened up civil
marriage for same-sex couples and allowed joint adoption.
It seems that Mexico
(population of around 110 million) has a Civil Code in
each state and in the Federal District (population of
nearly 9 million), and a separate Civil Code for matters
of federal law. This means that opening up marriage to
same-sex couples will be a state-by-state struggle (as
in the USA), and that the Federal District marriages of
same- ex couples will not necessarily be recognised at
the federal level (as in the USA).

Artículo 146.- Matrimonio es la unión libre de un hombre
y una mujer para realizar la comunidad de vida, en donde
ambos se procuran respeto, igualdad y ayuda mutua con la
posibilidad de procrear hijos de manera libre,
responsable e informada. Debe celebrarse ante el Juez
del Registro Civil y con las formalidades que esta ley
exige.

Artículo 146.- Matrimonio es la unión libre de dos
personas para realizar la comunidad de vida, en donde
ambos se procuran respeto, igualdad y ayuda mutua. Debe
celebrarse ante el Juez del Registro Civil y con las
formalidades que estipule el presente código.
Ratification by the governor has to be awaited now. The
sponsors of the amending law are pretty sure that he
will do so.
